Image-Based Sexual Abuse.
Also known as Non-Consensual Pornography, it identifies the non-consensual sharing of intimate material, pursuant to Article 612-ter of the Italian Penal Code, introduced in the summer of 2019.
It is a crime that occurs when sexually explicit material intended to remain private is shared without the consent of the person represented.
We often hear about Revenge Porn, a term which, however, only represents one part of the phenomenon.
IBSA is an umbrella definition (and one of the most widely used in literature to date) that allows us to understand all cases.
It is important to emphasize from the outset that exchanging intimate material (with mutual consent and between adults) is not a crime.
But subsequently sharing that material without the person’s consent is possible. If I send a photo of myself to someone else, it doesn’t become their property: they can’t dispose of it as they please or misuse it.
